Litigation is the process by which parties resolve their legal disputes, either through trial or earlier settlement. A litigator must be able to formulate a strategy to help resolve client disputes either through a trial in court, an alternative dispute resolution mechanism such as arbitration or mediation, or through settlement negotiations with an adverse party.

The attorneys of McDermottWard have experience in advising clients in a broad range of civil disputes in Virginia state and federal courts, with a particular emphasis on business disputes and fiduciary litigation (i.e., disputes relating to Wills, Trusts, Powers of Attorney and similar matters). Our litigation strategy is to provide our clients the best results in the most cost-efficient manner possible, meaning that many disputes may be resolved by an early settlement before the high costs of litigation are incurred. If a trial is the best course of action, however, our attorneys are adept at developing effective pre-trial and trial strategies.

In addition to litigation, our attorneys are experienced in utilizing all means permitted under Virginia law to recover a debt, including through judicial or non-judicial foreclosure.
