Health Care and Behavioral Health Law
The attorneys of McDermottWard have experience in advising clients in a broad range of issues related to Health Care and Behavioral Health Law. Our attorneys represent both private and governmental health care providers in navigating the Virginia and federal rules applicable to their businesses and patients.
Health care and behavioral health care are highly regulated professions. The individuals and their employers who provide such services are licensed and subject to the disciplinary review of their respective Commonwealth of Virginia departments, such as the Department of Health Profession and the Department of Behavioral and Developmental Health Services (DBHDS). In addition, the providers, profit and non-profit, have all the challenges of any other business, leases and contracts to be developed and reviewed, buy-sell agreements, human resource grievance procedures, commercial borrowing and more. This firm takes particular pride in helping its clients navigate these difficult waters.
We also represent individuals with special needs, or their families, to ensure that the individual receives the care that they need without the disruption of government aid. The services provided to these clients include creating trusts, such as special needs trusts, to be used for the care of a person with special needs and petitioning the court to have a guardian and/or conservator appointed to act on behalf of such person.
